Eligibility

• You must be at least 18 years old and legally authorized to enter into these Terms. If you are using WebAll on behalf of an organization, you represent and warrant that you have the authority to bind the organization to these Terms

Use of the Service

WebAll provides AI-powered call answering, response automation, follow-up messaging, and data processing tools. You agree to:

• Use the Service in compliance with all applicable laws and regulations. Ensure the accuracy of all information provided to us.
• Accept that WebAll may modify or discontinue any part of the Service at any time.

Data Collection and Retention

You acknowledge and agree that:

• WebAll may collect and store call audio, transcripts, caller metadata, and associated content.
• WebAll may retain this data indefinitely for service improvement, compliance, and operational purposes.
• You are solely responsible for obtaining any required consents from callers under applicable privacy or data protection laws.

Outbound Campaigns and Caller Retargeting

By using WebAll, you authorize us to:

• Store caller data and engagement history.
• Retarget previous callers through outbound sales or follow-up campaigns, including voice, SMS, or email, as permitted by law.
• Use anonymized or aggregated caller data to enhance service performance and customer outcomes.
• You are responsible for ensuring compliance with TCPA, CAN-SPAM, and any applicable regulations in your jurisdiction when using outbound communications.

Account Responsibilities

You are responsible for:

• Securing your WebAll login credentials and access.
• Activity that occurs under your account, even if not authorized by you.
• Maintaining compliance with privacy disclosures or other obligations to your customers or callers.

Prohibited Uses

You agree not to use the Service to:

• Violate any laws or third-party rights.
• Harass, spam, or mislead callers.
• Transmit malicious code or disrupt system functionality.

Intellectual Property

• All content, trademarks, and software related to the Service are owned by or licensed to WebAll. You may not copy, reproduce, or distribute any part of the Service without prior written consent.

Termination

• WebAll may suspend or terminate your access at any time for violation of these Terms or for operational reasons. Upon termination, your access to stored data may be revoked.

Disclaimers

• The Service is provided "as is" without warranties of any kind. WebAll makes no guarantees regarding accuracy, uptime, or specific business outcomes.

Limitation of Liability

• WebAll will not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service. Our total liability is limited to the amount you paid to us in the previous 12 months.

Modifications to Terms

• We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

• These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
